1. Scope
1.1 These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) apply to all contracts for the delivery of goods and the provision of digital content, in particular digital travel guides, concluded via our online store between Simone Leitner and Julia Perner, acting jointly under the business name PerLei GesbR (hereinafter referred to as “we” or “us”), and you as a consumer or business customer.
Any deviating terms and conditions of the customer shall not apply unless we have expressly agreed to their applicability.
1.2 A consumer is any natural person for whom the transaction in question does not form part of the operation of their business (§ 1 KSchG).
1.3 A business customer is a person for whom the transaction in question forms part of the operation of their business (§ 1 KSchG).
2. Conclusion of Contract
2.1 The products displayed in our online store do not constitute a legally binding offer, but rather an invitation for you to submit a binding offer to purchase.
2.2 You may submit your offer using the order form integrated into the online store. After selecting the desired products and completing the electronic ordering process, you submit a binding offer to conclude a contract for the products contained in your shopping cart by clicking the button that completes the ordering process.
2.3 We may accept your offer within five days,
- by sending you an express order confirmation in text form, in particular by email,
- by dispatching the ordered goods to you, or
- by making the ordered digital content available to you for download.
If more than one of these alternatives applies, the contract is concluded at the time when the first of the above alternatives occurs. If we do not accept your offer within the specified period, this shall be deemed a rejection of the offer.
2.4 The data relating to your order will be stored after you submit your order. You will receive the essential order details as well as the contract confirmation by email. The Terms and Conditions and the information on the right of withdrawal will be provided to you on a durable medium.
2.5 You may correct input errors at any time before submitting your order using the usual keyboard and mouse functions.
The contractual languages are German and English. The language selected by the customer in the online shop during the ordering process shall apply to the respective contract.
3. Right of Withdrawal / Right of Cancellation
3.1 Consumers generally have a statutory right of withdrawal for contracts concluded at a distance pursuant to § 11 FAGG.
3.2 Details regarding the exercise of the right of withdrawal, the applicable deadlines and the legal consequences are set out in our separate withdrawal policy, which is available on our website.
3.3 For digital content that is not supplied on a tangible medium, in particular our digital travel guides, the special provisions set out in our withdrawal policy apply with regard to the commencement of the withdrawal period and the possible early expiry of the right of withdrawal.
4. Prices and Payment Terms
4.1 The prices stated in our online store are total prices and include statutory value added tax. Shipping costs, where applicable, are not included in the stated product price and are shown separately during the ordering process.
No shipping costs apply to travel guides provided exclusively in digital form.
4.2 The payment methods displayed in the online store or at checkout are available. The available payment methods may vary depending on the delivery country and the order.
5. Delivery, Shipping and Provision of Digital Content
5.1 Delivery will be made to the delivery address specified by you.
5.2 If delivery fails for reasons for which you are responsible, in particular because you provided an incorrect delivery address, you may be charged the additional costs actually incurred as a result. This does not apply where you are not responsible for the failed delivery.
5.3 If you are acting as a consumer, the risk of loss of or damage to the goods generally passes to you only when the goods are delivered to you or to a third party designated by you who is not the carrier. If you have personally concluded the contract of carriage without using a shipping option proposed by us, the risk passes to you when the goods are handed over to the carrier.
If you are acting as a business customer, the risk passes to you as soon as we hand over the goods to the carrier or to another person or entity designated to carry out the shipment.
5.4 Collection of the goods in person is not possible for logistical reasons.
5.5 Digital travel guides are provided electronically after completion of the order. The download link will subsequently be available to you both on the order status page and by email.
6. Accessibility
Accessibility is important to us. We are constantly working to make reiselieblinge.de accessible to as many people as possible.

7. Retention of Title and Rights of Use
7.1 Physical goods remain our property until payment has been made in full.
7.2 Upon provision of a digital travel guide, you receive the right to use it for your own personal purposes. Any further reproduction, distribution, publication, making available to the public or commercial use is not permitted without our express consent, unless otherwise provided by law.
8. Warranty (Liability for Defects)
8.1 The statutory warranty rights apply.
8.2 If you are acting as a business customer within the meaning of the Austrian Commercial Code (UGB), the statutory duty to inspect and give notice of defects pursuant to § 377 UGB applies.
8.3 Consumers are requested to report any obvious transport damage to the delivery service as soon as possible and to inform us.
Failure to make such a report does not affect your statutory rights.
8.4 For consumer contracts concerning digital travel guides, the statutory warranty provisions for digital services additionally apply. We warrant that the digital content provided complies with the contractually agreed characteristics as well as the objectively required characteristics. Statutory update obligations remain unaffected.
9. Liability
The statutory liability provisions apply.
Liability for personal injury and liability for damage caused intentionally or by gross negligence shall not be excluded or limited.
Mandatory statutory liability provisions, in particular under the Austrian Product Liability Act, remain unaffected.
10. Redemption of Free Promotional Vouchers and Discount Codes
10.1 Vouchers issued free of charge as part of promotional campaigns are valid only for the period specified.
10.2 Vouchers may only be redeemed before completion of the ordering process. Subsequent crediting is not possible.
10.3 Cash payment of the voucher value and payment of interest on the voucher value are excluded.
10.4 Any unused value of a promotional voucher or discount code issued free of charge will not be paid out in cash and may no longer be used after the respective promotional period has expired.
10.5 In the event of a reversal or refund of an order, no more than the amount actually paid by the customer will be refunded. The value of a promotional voucher or discount code granted free of charge will not be paid out in cash. Statutory reimbursement claims remain unaffected.
11. Applicable Law
11.1 The law of the Republic of Austria shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
11.2 For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
12. Alternative Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board or another alternative dispute resolution body.
